So, the big news out of Washington is that Obama has compromised with the Republicans.  Tax cuts for everybody all the while extending unemployment benefits for some more amount of time.

Obama Seeking Aid for Jobless in Any Deal on Tax Cuts

WASHINGTON — The Obama administration is holding out for an extension of unemployment assistance and of a variety of expiring tax breaks for low-wage and middle-income workers as part of a deal with Congressional Republicans to extend all the Bush-era tax cuts.

But it is unclear how much leverage the White House has in the tax negotiations, given the drubbing Democrats took in the midterm elections, the tight Congressional calendar and a threat by Senate Republicans to block any legislation until the tax fight is resolved.

It is ironic that my biggest complaint about an Obama Presidency has turned out to be my favorite thing about him.

He’s an incompetent ass.

If Democrats Are THAT Stupid They Deserve What They [don’t] Get

Okay, so turns out that there is a concept in law that describes how parts of laws and/or contracts are interpreted.

The definition:

In law, severability (sometimes known as salvatorius, from Latin) refers to a provision in a contract which states that if parts of the contract are held to be illegal or otherwise unenforceable, the remainder of the contract should still apply. Sometimes, severability clauses will state that some provisions to the contract are so essential to the contract’s purpose that if they are illegal or unenforceable, the contract as a whole will be voided. However, in many legal jurisdictions, a severability clause will not be applied if it changes the fundamental nature of the contract, and that instead the contract will be void; thus, often this is not explicitly stated in the severability clause.

Severability clauses are also commonly found in legislation, where they state that if some provisions of the law, or certain applications of those provisions, are found to be unconstitutional, the remaining provisions, or the remaining applications of those provisions, will, nonetheless, continue in force as law.

Now, I didn’t know this.  But I:

  1. Have never written a contract.
  2. Have written a law
  3. Voted a a bill that would eventually become a law.

The fact that there are people in this world who have done either 1, 2 and/or 3 and STILL don’t know this rule about Severability is NOT my problem.

But it DOES speak volumes as to their qualifications to do any of the above!

Tax Hikes and Tax Cuts

Let’s get one thing straight.

We ALL agree that we ALL should pay SOME tax.

The government needs money to pay for things that governments do.

We can disagree about what a government should do and how much it costs that government to do it, but serious, we have to pay some form of tax.

That said, what we tax and how much we tax is a whole conversation that needs to be had.

Confusion in Durham

It’s heating up.  And something has to be done.

We need strong leadership on the issue and we need it now.

Sadly, Obama isn’t gonna be the guy to do it.

1.  He simply doesn’t know HOW to lead.  Which, of course, has been my main complaint all along.

2.  He doesn’t WANNA lead right now because it’ll interfere with his election prospects.

So, it’s left to the states and the towns.

Do nothing:

(Reuters) – Single-family home prices dipped in July, and are seen stabilizing near the lows without the homebuyer tax credit that ended in April…

This is surprising.

When left alone, people will normally buy and sell things at some market level.  When you pay people $8k to buy a house, don’t be surprised when the price of houses fluctuates between $1 and $8,000.

Back at it Again: Brains or Affirmative Action

Ahhh yes, my favorite morning show hosts are back at it.  Back at sounding rather, umm, well, less than intelligent.

The discussion of the moment is that Palin isn’t “smart” or “educated” but that Obama is.  And the proof of this is the fact that he graduated Columbia University and later attended, and graduated form Harvard aw School.  Further, he served as the editor of the Harvard Law Review.

And that’s where the hilarity begins.
